  1. Is the activity “water-dependent” or “non water-dependent”?
  2. Has a “practicable alternatives” analysis been conducted?
  3. Has the applicant “avoided and minimized”?
  4. Are any endangered or threatened species on site or in proximity to the site?
  5. Will publicly owned lands be negatively impacted?
  6. Will the proposed activity “cause or contribute to significant degradation of the waters of the United States”?
  7. What are the direct, indirect and cumulative impacts of the proposed activity?
  8. Is the proposed activity located in a flood plain?
  9. The Corps must complete a comprehensive Public Interest Review.
  10. The Corps must complete a comprehensive review of all wetland impacts.
  11. What sort of mitigation is proposed?
  12. Have you requested a public hearing?
  13. Request a copy of any permit issued and any EA/FONSI issued for the permit application.
  14. Copy your comment to all appropriate agencies and officials.
